Illinois' unlawful use of a weapon (UUW) law holds that every weapons charge is automatically a felony and therefore carries severe penalties. The key to UUW is that the crime is the actual possession of the firearm, not the commission of a crime using the firearm.

  • The firearm may be out of its case, loaded and immediately accessible.
  • The firearm may be out of its case, unloaded and with ammunition readily available.
  • The individual in possession of the firearm carries no valid firearms owner identification card (FOIC).
  • The individual has a previous felony conviction as a juvenile.
  • The individual is committing a misdemeanor violation of federal drug laws.
  • The individual is involved in gang-related activity.
  • The individual has had an order of protection issued against him or her within the past two years.
  • The individual was engaged in the commission of a misdemeanor involving violence.
  • The individual was under 21 and in unlawful possession of a handgun.
